Brian Aust

Brian Aust is in his 23rd year of practice as an immigration attorney. Brian works on all types of immigration cases. He represents individuals in family-based immigration matters, asylum, naturalization and removal defense. Brian has a particular interest in working LGBTQ clients. Brian is an active member of the American Immigration Lawyers Association (AILA) and frequent presenter at CLE’s on all types of immigration case types. Brian is fluent in Spanish.

Malinda Schmiechen is licensed to practice law in Minnesota and has been dedicated to improving the lives of people born outside the United States for over twenty years. Malinda understands the stress and strain of living outside your home country and traveling abroad because she lived in the former Yugoslavia and Poland and has visited countries in Africa, Central America, Asia and Europe.

Some Recent Victories

November 2023- The immigration court granted political asylum to clients from Nicaragua and Ethiopia.

USCIS granted a very rare Humanitarian Parole Request for an Afghan client. 

October 2023- The Immigration Judge terminated removal proceedings against an El Salvadorian client and opened up a pathway to citizenship. 

A client from Kenya was naturalized. Congratulations! 

The Immigration Court granted a gay man from Ecuador’s application for asylum. 

September 2023- Clients from the Netherlands and Gambia were granted Immigrant Visa’s and will be joining their families in the United States soon.

Clients from Canada and Mexico were granted adjustment of status and received their Permanent Resident Cards! 

July 2023- A District Court Judge granted an Ethiopian youth his Petition for Guardianship of At-Risk Juvenile! 

USCIS approved both an I-601, Application for Waiver of Grounds of Inadmissibility and Temporary Protected Status for a client from Burma. 

USCIS granted client Naturalization Applications from Palestine, Canada, Mexico and Somalia. 

A client from Mexico was granted an Immigrant Visa and will be joining her family in the United States shortly. 

June 2023- A mother and daughter from Colombia were granted permanent residence status. 

May 2023- A woman from Lebanon was granted adjustment of status after several years of waiting! 

USCIS approved both an I-601, Application for Waiver of Grounds of Inadmissibility and Adjustment of Status Application for a client from Republic of the Congo.
